GTC - General business Terms and Conditions of the online store

The following business conditions apply to orders through the 123GOLD online store placed by customers, who are also end consumers. The following general terms and conditions in the form valid from the time of placing each order are valid exclusively.

These general terms and conditions of business also apply exclusively when Bacio d’oro Schmuckvertriebs GmbH (hereinafter 123gold.de) makes unconditional shipments or services that differ from these general terms and conditions of business.

Presenting our products on the internet is just an unconditional invitation for you - the customer - to order products from our online store.

"By sending an order, which can be done by pressing the "buy now" button, you make a mandatory offer in order to conclude a sale-purchase contract. 123GOLD is not obliged to accept your offer."

Later you will get a confirmation from us by email, through which we confirm the registration of your order. The confirmation email does not yet represent our acceptance of the offer. The contract will be drawn up only when we confirm by email or telephone that the goods selected by you can be submitted to production in the form of your choice, at the latest, however, with the registration of an advance made by you or by shipping the ordered goods.

123gold.de delivers to your country in accordance with the delivery time mentioned on each product page. The goods are only available while the stocks last.

For the production of your wedding rings we need 2 to 5 weeks, depending on which model you have chosen and depending on how requested our manufacturers are. In the order confirmation we will also communicate the anticipated delivery time. Normally, the production is completed within 14 days of receiving the advance.

If we have to hurry: we will be happy to deliver your wedding rings or jewellery to you immediately. Please call us so we can arrange a rapid order!

We will deliver your order in the form of a shipment provided by the UPS courier service. The delivery will take place from Monday to Friday. The courier will need a signature.

We charge the following shipping costs:

•   On the territory of Germany
     no costs

•    On the EU territory
     The shipping costs will be charged by UPS for each order, starting at 45,- EUR

•    Shipping to Switzerland
     65 EUR with customs clearance; The refund of the German VAT will take place after obtaining the receipt for payment of the Swiss VAT.

•    Worldwide shipping
     Shipping costs must be requested - for this we need the full address.

Please note: UPS needs a signature upon delivery!

The prices indicated when placing the order are the valid prices. All prices include valid legal VAT.

As a payment method we accept the advance by bank transfer or PayPal.

For the use of the payment system of the external service provider such as PayPal, its general conditions of business also apply.

The data entered in the payment process will not be saved by 123gold.de. The backup can only be done by each payment operator separately, according to its data protection provisions.

A prepayment is required, because at 123GOLD, each wedding ring and each piece of jewellery must be produced according to your desired specifications. You will pay according to the following scheme:

•  When placing the order you will pay at least 50% of the order value.

•  As soon as the rings/jewellery have been produced, you will receive a notification from us. Then you will pay the rest of the amount.

•  From the moment we register the payment entry, we will move on to the delivery of the order.

You will obtain our bank information once your order is confirmed.

Please note: The production of the ordered goods can be charged only after our account has been credited with 50% of the contract value. And the delivery of the ordered goods will take place only after the entry of the payment for the total value of the order!

The goods remain the property of the 123GOLD online store until full payment.

The right to compensation belongs to you as a customer only when your claims are definitively, irrevocably established or will be recognized by 123gold.de. In addition, you are entitled to exercise the right of detention only to the extent that your counterclaim is based on the same contractual relationship.

Unless otherwise specified, the legal provisions for the warranty are valid.

Indication: of course, the wedding rings and jewellery made of materials offered by us, will show from the first day of wearing traces of wear such as scratches and bumps, which occur due to touching them with hard materials (such as glass or iron). If you somehow chose Rhodium plating when you placed the order, it will be removed relatively quickly by wearing rings/jewelry. The same goes for matte finishes. In the case of white Gold material, a slight shade of yellow can be seen over time in the material, due to the erosion of Rhodium.

The size of the ring chosen by you when placing the order of the wedding rings or rings is set by you alone. Your fingers will suffer from influences such as heat, cold, fluid intake, time of day, weight gain, weight loss or the practice of certain sports (e.g. tennis, handball) and thus may change their circumference. This can lead to inaccuracies in size measurement. Please keep this in mind when determining the sizes.

In case of cancellation of an order not yet in production, a cancellation fee of 10% of the value of the order will be charged. However, this cancellation fee can be deducted from the value of a new order placed.

If the order is already in the production process, the cancellation fee will amount to 50% of the order value. This increased cancellation fee cannot be deducted if a new order is placed.

The cancellation is a policy of goodwill and is independent of the right of withdrawal.

Consumers are generally entitled to a right of withdrawal.

The contract language is German.

In order to conclude and carry out any contracts, concluded through our online store, the German law applies. The validation of the UN acquisition right is excluded.

This does not exclude the foreign right of consumer protection. The mandatory provisions on consumer protection in the country of origin of the customer (consumer) are still applicable.

If one or more regulations of these general conditions of business will become null and void, then it does not entail the nullity of the entire contract. The regulation that has become null and void will be replaced by the relevant legal regulation.

The European Commission provides a platform for the settlement of out-of-court disputes in the online environment (OS Platform), located at https://ec.europa.eu/odr.

Indication according to Article 36 paragraph 1 VSBG: 123gold.de is not in principle prepared and required to participate in the dispute settlement process before the Consumer Arbitration Committee.

123gold.de reserves the right to assign or pledge to third parties all payment orders resulting from the delivery of goods, including installment payments.
